Terms and Conditions
TURNAROUND
Our typical turnaround time is 8 to 16 business days on apparel and 5 to 7 business days on graphics. Some orders may take less/more time depending on order size and design complexity. Turnaround time begins when your down
payment has been paid in full or as agreed upon. GH Customs will not be responsible for missed deadlines due to
weather conditions, power interruptions, back-orders, or errors from distributors, shipping errors or anything else
outside our control. If we expect or foresee any problems, we will gladly inform you of the problem and work with you to reach a solution.
ARTWORK CREATION AND OWNERSHIP
If you ask us to create a custom logo that you would like us to use on a project like apparel, you will be charged for DESIGN TIME plus production of apparel. Standard copyright rules apply.
If you would like us to create a custom logo or design that you would like to use freely and own original files to, the cost will include the labor and skill to produce the design as well as ownership to all artwork files for your desired use.
Until the full payment is received, all logo designs shared with you as proofs remain the intellectual property of GH Customs Apparel and Graphics. The designs are protected under copyright law and may not be used, reproduced, or distributed in any capacity without prior authorization or payment in full. Unauthorized use of these designs constitutes a violation of intellectual property rights and may result in legal action.
Artwork submitted by you for any project, which we are not fully designing, is not owned by GH Customs but you or its rightful owner. We will never reproduce your artwork without your consent.
Additional fees may occur at completion of production on more intricate designs due to the amount of work and precision that may have been required to accomplish your order.
DESIGN REVISIONS
In order to keep the number of revisions/changes within the project scope, please be as detailed as possible in regard to what you would like to see corrected. Revision requests in excess of what the project already includes may require additional fees. The purpose of providing design revisions is to assist the Client in the design process.
The goal is to create a design that the Client finds satisfactory to their needs. Revisions are used only for small layout modifications, typographic edits, or changes to the color palette. A revision DOES NOT include a complete re-design or additional new design concepts provided to the client except for those with minor revisions.
PLACEMENT
While printing, we do our best to ensure designs are printed in consistent locations on all shirts in the run. However, small variations should be expected. All garments are sewn differently and variations in each individual shirt may result in slightly varied placements. A 1″ allowance in any direction off the proofed location is considered acceptable. If the desired print location is near a seam or a collar, these variances may be more noticeable. GH Designs will not be responsible for print location variances within the 1″ allotment.
PAYMENT
GH Customs requires 50% down payment before starting any design or production (exceptions may occur upon GH Customs' consent). Client must pay remaining balance before Final Design Files or an Product can be release. This policy ensures our end and yours.
CARE INSTRUCTIONS
To ensure longevity of your print and image vibrancy, we always recommend machine washing your shirts in cold water; inside out and tumble drying on low or medium heat.
You should expect a small amount of fading (if any) with water based or discharge prints. Because they are basically dyed fabrics, the printing may fade along with the fabric after repeat washings. This is not a print defect.
CUSTOMER SUPPLIED GOODS
We do print on customer supplied goods if customer is aware and ok with the fact that there is a chance that an item/items can be ruined or misprinted and GH Customs will not be responsible for replacing any items.
SUBJECTIVITY
After apparel mockup has been approved by yourself and produced by GH Customs; GH Customs will not be responsible if you do not like the look or fit of a garment and/or the artwork printed on it. Due to the unreliability of matching fabric colors and ink colors by computer monitors we cannot guarantee a color to look exactly how it looks on screen. We will gladly work closely with you to make sure the garment selected fits your needs and meets your expectations. However, we expect each client to do some research of their own. Garment specs are always available to you. If you are still unsure of a product’s look, color, or sizing, we suggest ordering a sample prior to production to see how your design will look or how a garment will fit. If you need a sample, please request it so that there are no misunderstandings. Mockups are only intended to get a general feel for what the end product will look like. We do our best to get it as close to the mockup as possible. Please note that samples will delay turnaround times.
DELIVERY
Delivery may be available upon request within Carteret and Craven County, NC for an additional $10-$20 depending on location.
UPS delivery for an additional charges. (UPS rates depending on weight and time)
NON - REFUNDABLE DEPOSIT CLAUSE
Upon acceptance of the estimate and receipt of the partial deposit, the client acknowledges that work will commence. This deposit is non-refundable once the project has begun. The deposit is used to secure time, materials, and labor for the project. If the client decides to cancel or halt the project after the deposit is paid and work has started, the deposit will not be refunded.
PROJECT MILESTONES AND DELIVERABLES
The project will be completed in distinct phases, as outlined in the project agreement and the accepted estimate. The following milestones will guide the progress of the project:
Initial concept presentation
Client review and approval of concepts
Revisions (if necessary)
Final design approval
Production and final delivery - Each milestone requires client approval before moving to the next phase. Failure to provide feedback or approval within a 20 days may delay the project, and the client may be subject to additional charges for storage or re-scheduling.
CLIENT RESPONSIBILITIES
The client is responsible for providing all necessary materials, such as logos, content, and brand guidelines, in a timely manner. The client must also provide feedback and approvals at key stages of the project as outlined in the project milestones. Delays in providing these items or feedback may result in delays in project completion, and the client will be responsible for any additional costs incurred due to these delays.
PROJECT COMMUNICATION AND TIMELY RESPONSES
Though we try to work with all of our clients as much as possible, to ensure projects move forward smoothly and are completed on time, we require timely responses to our communication. If we do not receive feedback, approvals, or required materials from the client within 21 days, we will assume the project has been put on hold or terminated. At this point:
Any work completed up to that time will be billed, and no refunds will be issued for deposits or payments made.
Resuming a paused project may require an additional fee to cover restarting the workflow or reallocating resources.
It is the client’s responsibility to communicate delays or request an extension in writing.
CANCELLATION POLICY
If the client chooses to cancel the project after the partial deposit has been paid and work has commenced, the client is responsible for payment for all work completed up until the cancellation point. The deposit is non-refundable, and the client agrees to pay for any completed work and services provided up until the point of cancellation. Cancellations must be submitted in writing, and any remaining balances will be due immediately.
INTELECTUAL PROPERTY RIGHTS
Until the full payment is received, all logo designs shared with you as proofs remain the intellectual property of GH Customs Apparel and Graphics. The designs are protected under copyright law and may not be used, reproduced, or distributed in any capacity without prior authorization or payment in full. Unauthorized use of these designs constitutes a violation of intellectual property rights and may result in legal action. Designs provided for review purposes are protected under U.S. Copyright Law (Title 17 of the United States Code). These designs cannot be reproduced, altered, distributed, or used in any form without the full payment of the agreed-upon amount, or Final Files have been delivered to you upon project completion. Failure to comply with this notice will result in legal action to protect our intellectual property rights. This may include seeking damages, legal fees, and any other remedies available under applicable law.
